Auroville Brand Jurisprudence – an institution
Purpose
To establish a research-based impartial, empowered, competent, futuristic, dedicated institution structure in Auroville which, as a last resort after trying all “new-age alternatives”, offers a binding verdicts to all disputes, all contentious issues, all individual and group concerns and grievances, whether of personal nature or public interest, within the framework of Auroville Brand constitution, and in the light of Sri Aurobindo’s & the Mother’s knowledge of the individual & group psychology, individual & group progress, of sense of right and just.
Explanation
1. Auroville Charter speaks of “taking advantage of all discoveries from within and without”. It means that in the process of fulfilling her mission in the world, Auroville will accept and employ not only the psychological and spiritual knowledges and practices but also, when necessary, knowledge and practices the world has discovered and employed in the long march of its journey from pre-historic times to present civilisation.
2. Having lived in Auroville for more than three decades, having seen the organisation of collective live in Auroville, Aryadeep S. Acharya does see a need for an impartial, empowered, competent, futuristic, dedicated institution structure in Auroville which, as a last resort after trying all the alternatives for resolutions of conflicts, offers binding verdicts to all disputes, all contentious issues, all individual and group concerns and grievances, whether of personal nature or public interest.
3. Sri Aurobindo & The Mother have offered a new light on the constitution of the human being, and how the best elements of the human beings can be cultivated, made active, brough forward. They have also given a new light on the future of life on earth.
4. However, the incorporation of this new light in the present realities has to start from the present stage of human development, existing realities of human life.
5. Aryadeep S. Acharya believes that one of the things Auroville could learn from the world is the system of jurisprudence the society has evolved over the centuries, especially when the contentious issues (between individual and individual, between individual and community, between the citizen and administration, between the administrators themselves) could not be resolved within reasonable time in an effective and amicable way employing all the alternatives of conflict resolutions.
6. After all, in Sri Aurobindo’s light, rule of reason should not end until the rule of the psychic being – the inner soul – is established.
7. Aryadeep S. Acharya, therefore, envisions an institution in Auroville dedicated to developing a system of Auroville jurisprudence which will include and offer various alternatives to conflicts and grievances resolution, and finally, when necessary traditional system where competent judges study a contentious issue from all angles within a given constitutional framework and give a verdict which is binding and, if necessary, enforceable to all parties.
8. Aryadeep S. Acharya believes that this will be an institution of individual and collective learning and progress because it will offer everyone an opportunity to subordinate their personal views to the views of an impartial body, what is called the sportsmanship.
9. This institution will pave the way for things move onward rather than remain unsolved, or at the level of debate and discussion for unreasonable span of time.
10. This will also help the resolutions of the issues within Auroville rather than taking resort to the existing institution of courts outside Auroville which is already overburdened
Present status
Just a practical need felt by Aryadeep S. Acharya. Things are only on paper at this stage.
